Terms and Conditions
These Terms and Conditions ("Terms") govern access to and use of the AYLENSALE online marketplace operated by AYLENSALE LTD, a company registered in England and Wales ("we", "us", "our").
1. About us
AYLENSALE LTD (company number 16874751) operates AYLENSALE, a UK marketplace for deposit-backed auctions and related services for both business ("B2B") and consumer ("B2C") users. Registered office: 2a Blenheim Walk, Corby, England, NN18 9HA.
2. Eligibility
You must be at least 18 years old and have legal capacity to contract. Business users must have authority to bind their organisation.
3. Account registration
You must provide accurate information, keep credentials secure, and accept our legal documents at registration. We may suspend accounts for breach, fraud, or regulatory reasons.
4. Marketplace role
AYLENSALE LTD provides an online venue connecting sellers and buyers. Unless expressly stated, we are not a party to sale contracts between users. We do not take title to listed goods except where expressly stated in a separate agreement.
5. Deposits and auctions
Participation in deposit auctions is subject to our Deposit Policy, Auction Terms, Buyer Terms, and Seller Terms. Deposits may be held, retained, refunded, or forfeited according to those documents and applicable law.
6. Fees and payments
Fees, commissions, and payment processing terms are disclosed before checkout or listing. Prices are shown in GBP unless stated otherwise.
7. Prohibited conduct
You must not list illegal goods, misrepresent items, manipulate bidding, circumvent deposits, launder money, harass users, or interfere with platform security.
8. Suspension and termination
We may suspend or terminate access for breach, risk, legal compliance, or protection of users. Provisions intended to survive termination shall continue.
9. Liability
Nothing in these Terms excludes liability that cannot be excluded under UK law. Subject to applicable law, our aggregate liability arising from platform use is limited to the greater of £100 or fees paid to us in the 12 months before the claim, except for death, personal injury, fraud, or statutory rights that cannot be limited.
10. Consumer rights
If you are a consumer, you retain statutory rights under the Consumer Rights Act 2015 and other UK law. Business users acknowledge that certain consumer protections may not apply.
11. Disputes
Disputes between users should first be raised through our dispute process. These Terms are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction, without prejudice to mandatory consumer jurisdiction rules.
12. Changes
We may update these Terms. Material changes will be notified in-app or by email. Continued use after the effective date constitutes acceptance where permitted by law.
